These Terms & Conditions ("Terms") govern your use of the Fifth AI Consulting website and any communications, including text messages and email, that result from submitting your information through this site or engaging our services. By using this site or providing your contact information, you agree to these Terms.
Fifth AI Consulting provides AI automation consulting services to businesses, including but not limited to workflow automation, customer communication systems, managed SMS infrastructure, and related advisory work. Details of specific engagements are agreed separately with each client through a Client Service Agreement.
SMS messages you receive in connection with Fifth AI Consulting may come from two sources:
If you provide your phone number and opt in through a form on this website, Fifth AI Consulting may send you text messages related to your inquiry, scheduling, or follow-up regarding our services. By checking the SMS consent box on our contact form, you expressly agree to receive these messages. Consent is not a condition of purchasing any service.
Fifth AI Consulting operates SMS automation infrastructure on behalf of client businesses (such as HVAC companies, plumbers, roofers, and other home services providers). If you have interacted with one of our client businesses — for example, by calling their phone number — you may receive an automated SMS from a number managed by Fifth AI Consulting on that business's behalf. These messages are sent only with your explicit consent, obtained through an IVR prompt during your call.
For missed-call text-back automations, consent is obtained when you press 1 during an automated voice prompt (IVR) that clearly states you will receive a text message. No SMS is sent without this explicit keypress consent, in compliance with the Telephone Consumer Protection Act (TCPA).
Message frequency varies based on your interactions. Message and data rates may apply depending on your mobile carrier and plan.
You may opt out of text messages at any time by replying STOP to any message. Reply HELP for assistance. After opting out you will receive one final confirmation message and no further messages will be sent.
Carriers are not liable for delayed or undelivered messages. Fifth AI Consulting is not responsible for delays or failures in message delivery caused by your mobile carrier or device.
Fifth AI Consulting creates and manages dedicated SMS accounts on behalf of client businesses, registered under each client's legal business name and EIN. This is a managed service — the client business authorizes Fifth AI Consulting to operate this infrastructure on their behalf. All SMS campaigns are registered with US carriers through the A2P 10DLC system and comply with applicable carrier regulations and TCPA requirements.
You agree not to use this website in any way that could damage, disable, or impair its operation, or to submit false or misleading contact information.
This website and its content are provided "as is" without warranties of any kind. Fifth AI Consulting does not guarantee specific business outcomes from automation services, as results depend on factors specific to each client's business. We are not a law firm and nothing on this website constitutes legal advice.
To the fullest extent permitted by law, Fifth AI Consulting is not liable for any indirect, incidental, or consequential damages arising from your use of this website, our text/email communications, or our automation services, including delayed or failed message delivery, third-party platform outages, or missed leads resulting from automation downtime.
Our automation systems rely on third-party platforms including Make.com, SignalWire, Google, and Netlify. We are not responsible for the availability, accuracy, or practices of these third-party services. Links to third-party tools or services on this site are provided for convenience only.
We may update these Terms from time to time. Continued use of this website after changes are posted constitutes acceptance of the revised Terms. The date at the top of this page reflects the most recent revision.
These Terms are governed by the laws of the State of Ohio, without regard to conflict of law principles.
